# Terms of service

Last updated: October 14, 2026. These terms apply when you use this website, buy our themes and modules, or hire us for HubSpot development work.

## 1. About these terms

This website is run by Pixtheme. By using the site or our services you agree to these terms. If you do not agree, please do not use them. Questions? Email [hello@pixtheme.com](mailto:hello@pixtheme.com).

## 2. Using this website

- You may browse the site and share links to it for any lawful purpose.
- You may not copy, resell or republish its design, code or content without our written permission.
- You may not try to break, overload or gain unauthorised access to the site or to any HubSpot systems behind it.

## 3. Project work

Every project starts with a written proposal or statement of work that sets out the scope, price, timeline and deliverables. If that document and these terms disagree, the proposal wins.

- **Fixed price:** the price in your proposal covers the agreed scope. Work outside the scope is quoted separately before we start it.
- **Payment:** unless your proposal says otherwise, we invoice 50% at kickoff and 50% at launch, payable within 14 days.
- **Your part:** you provide content, feedback and HubSpot portal access on time. Delays on your side can move the launch date.
- **Launch guarantee:** any launch-date guarantee applies only as written in your proposal.

## 4. Ownership

Once a project is paid in full, you own the theme, modules, templates and app code we build for you, and we hand over the source code. We keep the right to reuse general know-how, techniques and our own pre-existing tools and components, which you receive a permanent licence to use on your sites.

## 5. Themes and modules from the marketplace

Themes and modules bought through the HubSpot Template Marketplace are licensed under the HubSpot Marketplace terms, which apply in addition to these terms. Refunds for marketplace purchases follow HubSpot's refund policy.

## 6. Third-party services

Our work runs on HubSpot and may use other third-party services. Their own terms, pricing and availability apply, and we are not responsible for outages or changes they make.

## 7. Warranties

We fix bugs in our own work that you report within 30 days of launch at no extra cost. Apart from that, the website and services are provided as is, and we do not promise any specific business results such as traffic, leads or revenue.

## 8. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits or data, and our total liability for any project is limited to the amount you paid us for that project.

## 9. Ending a project

Either side can end a project with written notice. You pay for the work done up to that date, and we hand over everything that has been paid for.

## 10. Privacy

Our [privacy policy](https://www.pixtheme.com/privacy-policy?hsLang=en) explains how we handle personal data.

## 11. Changes and governing law

We may update these terms from time to time. The date at the top shows the latest version. These terms are governed by the laws of \[country or state\], and its courts have jurisdiction over any dispute.
